Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement

Please read this document carefully. By participating in any activities organised by Random Sunday Highs (“RSH”), you acknowledge that you have read, understood, and agree to be bound by the terms set out below.

1. Express Assumption of Risk

I, the participant, acknowledge that I have been informed of and understand the inherent risks associated with trail running, hiking, transportation, and related outdoor activities, including travel to and from activity locations.

Such risks include, but are not limited to:

1. Risk of serious injury, permanent disability, or death arising from participation in activities.
2. Falls resulting in fractures, head, neck, or spinal injuries.
3. Natural hazards including but not limited to landslides, rockfall, inclement weather, lightning, and extreme environmental conditions.
4. Risks arising from uneven terrain such as rocks, roots, mud, sand, snow, or ice.
5. Risks associated with river crossings or water-related obstacles.
6. Equipment failure or malfunction, whether owned, borrowed, or rented.
7. Negligence of myself or others, including organisers, agents, contractors, or participants.
8. Heat or cold-related illnesses including dehydration, heat stroke, hypothermia, or frostbite.
9. Encounters with wildlife, insects, or reptiles.
10. Accidents occurring in remote locations without immediate access to medical facilities.
11. Physical fatigue, reduced coordination, or impaired judgment increasing the likelihood of accidents.
12. My own physical condition, fitness level, and ability to follow instructions.

I understand that the above list is not exhaustive and that unforeseen risks may arise, which may result in injury, illness, or death.

2. Release of Liability and Waiver of Claims

In consideration of being permitted to participate in RSH activities, I agree as follows:

1. I hereby release, waive, and discharge RSH and its associated interest groups, including their organisers, officers, employees, volunteers, agents, contractors, and partners (collectively referred to as the “Released Parties”), from any and all liability for injury, disability, death, or loss or damage to property arising from my participation, whether caused by negligence or otherwise.
2. I agree not to make any claims or institute any proceedings against the Released Parties for any injury, damage, or loss arising from the activities, including claims by my estate, heirs, or assigns.
3. I agree to indemnify and hold harmless the Released Parties from any claims, demands, or actions brought by third parties arising out of my participation in the activities.
4. I confirm that I am not relying on any representations, statements, or warranties other than those expressly set out in this agreement.

This agreement shall be binding to the fullest extent permitted by law. If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force.

3. Consent to Photography and Recording

By participating in any RSH event or activity, you acknowledge and consent that photography, audio recording, and video recording may take place.

You grant RSH and its associated interest groups, partners, and representatives the right to:

• capture, record, and reproduce your image, voice, or likeness;
• use such recordings for promotional, marketing, or informational purposes; and
• publish such content on websites, social media platforms, or other media channels.

You waive any right to inspect or approve the use of such materials and release all parties involved from any liability arising from the use of such recordings.
